Last updated: June 2022
Article 1 – LEGAL NOTICE
This website, accessible at the URL www.luuckk.com (the "Site"), is published by:
Osoleil Limited, a company registered and headquartered at Shop 185G/F, Hang Wai Ind. Centre, No.6 Kin TAI ST., TUEN MUN.
(Hereinafter referred to as "Osoleil Limited").
The Operator can be contacted at the following email address: contact@luuckk.com
Article 2 – GENERAL PROVISIONS REGARDING THESE TERMS AND CONDITIONS
The general terms and conditions of sale (the "Terms and Conditions of Sale", or "GTC") apply exclusively to the online sale of products offered by the Operator on the Website.
The GTC are made available to customers on the Site where they can be directly consulted and can also be communicated upon simple request by any means.
The GTC are enforceable against the customer, who acknowledges having read and accepted them before placing an order by ticking a box or clicking on the button provided for this purpose. Validation of the order by its confirmation constitutes full acceptance by the buyer of the GTC in force on the date of the order, the retention and reproduction of which are ensured by the Operator.
Article 3 – PRODUCT DESCRIPTION
The Site is an online store selling jewelry, accessories, and home decor (hereinafter the "Product(s)") open to any natural or legal person using the Site (the "Customer").
Each Product presented on the Site is accompanied by a description (provided by the supplier or accessible via a link on the manufacturer's website on the Site) specifying its essential characteristics. Any photographs illustrating the products do not constitute a binding contractual document. The Product's user instructions, if essential, appear on the Site or are provided at the latest upon delivery. Products comply with the requirements of current French law.
The Customer remains responsible for the terms and consequences of their access to the Site, particularly via the Internet. This access may involve fees paid to technical providers such as Internet service providers, which remain the Customer's responsibility. In addition, the Customer is solely responsible for providing and maintaining all equipment necessary to connect to the Site.
The Customer acknowledges having verified that their computer configuration is secure and in proper working order.
Article 4 – CREATING A CUSTOMER ACCOUNT
To place an order on the Site, the Customer must first create a personal customer account. Once created, to access it, the Customer must log in using their username and secret, personal, and confidential password. It is the Customer's responsibility not to disclose their username and password in accordance with the PERSONAL DATA article of these Terms and Conditions. Each Customer agrees to maintain strict confidentiality regarding the credentials, particularly username and password, allowing access to their customer account, acknowledging that they are solely responsible for access to the Service via their username and password, barring proven fraud. Each Customer further agrees to notify the Operator without delay in the event of loss, misappropriation, or unauthorized use of their username and/or password.
After creating their personal customer account, the Customer will receive a confirmation email.
During registration, the Customer agrees to:
- provide true, accurate, and up-to-date information when filling out the service registration form, and in particular not to use false names or addresses, or names or addresses without authorization.
- keep registration data updated to continuously ensure its truthful, accurate, and current nature.
The Customer further agrees not to make available or distribute unlawful or objectionable content (such as defamatory information or identity theft) or harmful material (such as viruses). Failing this, the Operator reserves the right to suspend or terminate the Customer's access to the Site at the Customer's sole fault.
Article 5 – ORDERS
The Operator strives to ensure optimal availability of its Products. Product offers are valid while supplies last.
If, despite the Operator's best efforts, a Product turns out to be unavailable after the Customer's order, the Operator will notify the Customer by email as soon as possible, and the Customer will have the choice between:
- the delivery of a Product of equivalent quality and price to that originally ordered, or
- a refund of the price of the ordered Product within thirty (30) days of payment of the amounts already received.
It is agreed that apart from refunding the price of the unavailable Product, if this option is chosen by the Customer, the Operator is liable for no cancellation indemnity, unless the failure to perform the contract is directly attributable to the Operator.
Unless expressly stated otherwise in these Terms and Conditions and without prejudice to the statutory right of withdrawal, Customer orders are firm and definitive.
When placing an order, the Customer must select the chosen Products, add them to their shopping cart, indicating the selected items and desired quantities. The Customer has the opportunity to review order details and the total price, and return to previous pages to modify the contents of their cart before confirming.
The Customer undertakes to read the Terms and Conditions of Sale then in effect before accepting them and confirming the terms and any delivery and withdrawal fees prior to paying for the order. Order confirmation implies acceptance of the GTC and forms the contract.
A copy of these Terms and Conditions as accepted by the Customer will be sent via email upon confirmation of the Order for reference.
Contractual information regarding the order (including the order number) will be confirmed by email in due time and no later than upon delivery. The Operator strongly advises the Customer to print and/or archive this order confirmation on a reliable and durable medium as proof. A digital invoice is made available in the "My Account" section. The Operator also strongly advises the Customer to print and/or archive this invoice on a reliable and durable medium as proof.
Any email sent to the Customer in connection with an order will be sent to the email address used to log into their customer account.
The Operator reserves the right not to accept the Customer's order for any legitimate reason, including in cases where:
- The Customer does not comply with the Terms and Conditions in effect at the time of their order;
- The Customer's order history shows outstanding amounts due from previous orders;
- One of the Customer's previous orders is subject to an ongoing dispute;
- The Customer has not responded to an order confirmation request sent by the Operator.
The Operator archives sales contracts for Products in accordance with applicable legislation. Upon request sent to contact@luuckk.com, the Operator will provide the Customer with a copy of the contract in question.
Any order modification by the Customer after order confirmation is subject to the Operator's prior consent.
The information provided by the Customer when placing the order (including delivery name and address) is binding. Consequently, the Operator cannot be held liable should an error made during order placement prevent or delay delivery.
The Customer declares having the full legal capacity to enter into commitments under these Terms and Conditions.
Registration is open to legally capable adults and minors provided they act under the supervision of a parent or legal guardian holding parental authority. In no event is registration permitted on behalf of third parties unless duly authorized to represent them (e.g., a corporate entity). Registration is strictly personal to each Customer.
In the event of a breach by the Customer of any provision hereof, the Operator reserves the right to terminate the Customer's account without prior notice.
Article 6 – PAYMENT METHODS AND SECURITY
The Customer expressly acknowledges that any order placed on the Site involves an obligation to pay, requiring payment of the purchase price in exchange for the supply of the ordered Product.
In any event, the Operator reserves the right to verify the validity of the payment prior to dispatching the order by all necessary means.
The Operator uses an online payment solution.
Orders may be paid using one of the following payment methods:
- Credit/Debit Card Payment. Payment is processed directly through the secure banking servers of the Operator's bank; the Customer's banking details do not transit through the Site. Payment details are protected using SSL (Secure Socket Layer) encryption. In this way, this data is inaccessible to third parties. The Customer's order is recorded and confirmed once payment is accepted by the bank. The Customer's account will only be debited with the corresponding amount when (i) the card details used have been verified and (ii) the charge has been accepted by the issuing bank. An inability to debit the amounts due will result in immediate cancellation of the sale. A card may be rejected in particular if expired, if the Customer's credit limit has been reached, or if the entered details are incorrect.
- E-wallet Payment (such as PayPal). The Customer already holds an account with the electronic wallet used by the Operator. The Customer can use this account and securely pay for the order without sharing banking details.
Where applicable, an order validated by the Customer will only be considered effective once the secure payment center has approved the transaction.
As part of verification procedures, the Operator may require the Customer to provide necessary documents to finalize the order. These documents will not be used for any other purpose.
Article 7 – PRICE PAYMENT
The prices of Products in effect at the time of the order are indicated in euros including all applicable taxes (VAT) and excluding delivery and shipping fees. In the event of a promotional offer, the Operator agrees to apply the promotional price to any order placed during the promotional campaign period.
Prices are payable exclusively in euros (€). The full price is due upon order confirmation. Prices include any discounts and rebates the Operator may grant.
If shipping or delivery charges apply, they will be added to the Product price and clearly indicated before the Customer finalizes the order. The total amount due by the Customer and its itemization are displayed on the order confirmation page.
Article 8 – FORMATION OF THE CONTRACT
The contract between the Operator and the Customer is formed when the Customer submits their order confirmation.
The Customer's attention is particularly drawn to the method of order acceptance on the Site. When placing an order, the Customer must confirm it using the "double-click" process: after selecting Products and adding them to the cart, the Customer must check and, if needed, adjust the cart contents (identification, item quantities, prices, delivery terms, and shipping fees) before confirming by clicking "Confirm Delivery", then acknowledge acceptance of these GTC before clicking "Pay Now", and finally confirm the order after entering payment details. The "double click" constitutes an electronic signature equivalent to a handwritten signature. It represents irrevocable and unconditional acceptance of the order by the Customer.
Communications, purchase orders, and invoices are archived by the Operator on a reliable and durable medium to create a faithful and lasting copy. These records may be produced as evidence of the contract. Unless proven otherwise, data recorded by the Operator via the Internet or telephone constitutes proof of all transactions entered into between the Operator and its Customers.
The order may be cancelled by the Customer by registered letter with acknowledgement of receipt or in writing on another durable medium in case of:
- delivery of a Product that does not conform to its declared characteristics;
- delivery exceeding the deadline specified on the purchase order or, in the absence thereof, within thirty (30) days following contract conclusion, after the Operator has been formally requested under the same terms to make delivery within a reasonable additional period, without success;
- a price increase not justified by a technical change to the product required by public authorities.
In all such cases, the Customer may claim a refund of any deposit paid, plus interest calculated at the legal rate from the date the deposit was received.
The order may be cancelled by the Operator in case of:
- the buyer's refusal to accept delivery;
- non-payment of the price (or the balance of the price) upon delivery.
Article 9 – RETENTION OF TITLE
The Operator retains exclusive ownership of Products ordered on the Site until full payment of the price has been received, including any shipping fees.
Article 10 – SHIPPING AND DELIVERY
Online sales offers presented on the Site are intended for consumers residing in France or, where applicable, in a member state of the European Union, and for deliveries within these geographical regions.
Delivery means the transfer to the Customer of physical possession or control of the Product.
The Operator offers various delivery methods depending on the nature of the Product.
Shipping costs are those specified at checkout and are accepted upon validating the order.
In accordance with the delivery deadline indicated on the Site for each Product, the Operator undertakes to deliver Products within a maximum of thirty (30) days following order receipt.
Delivery timeframes are stated in business days on the Site during checkout. These timeframes include order handling and dispatch as well as the carrier's transit time.
The Operator undertakes to dispatch Products within the timeframes indicated on each Product page and in the cart, provided that payment for the order has not been previously declined.
However, should one or more Products not be deliverable within the timeframe initially stated, the Operator will send an email informing the Customer of the new estimated delivery date.
Products will be delivered to the address provided by the Customer during the ordering process. The Customer is therefore responsible for verifying that this address contains no errors. The Operator cannot be held liable if an erroneous address provided by the Customer prevents or delays delivery.
Upon delivery, signature of a delivery slip may be required.
Upon delivery, it is the Customer's responsibility to verify that the delivered Products conform to their order and that the package is sealed and undamaged. If this is not the case, the Customer must state this on the delivery slip. No claim regarding the quantity or condition of the Product will be accepted unless recorded on the delivery slip.
Article 11 – RIGHT OF WITHDRAWAL
If a delivered Product does not provide complete satisfaction, the Customer may return it to the Operator. The Customer has fourteen (14) days to do so from the date of receiving the order.
Pursuant to Article L.221-21 of the French Consumer Code and to exercise this right of withdrawal under the terms of Articles L. 221-18 et seq. of the French Consumer Code, the Customer is invited to send an email to contact@luuckk.com
The Operator will send an acknowledgment of receipt of the Customer's withdrawal request via email.
Where applicable, the Customer may exercise their right of withdrawal by notifying the Operator of the following information:
- name, physical address, phone number, and email address;
- unequivocal statement of withdrawal (e.g., a letter sent by postal mail, fax, or email where such contact details are available and appear on the standard withdrawal form). The Customer may use the model withdrawal form, but it is not mandatory.
Return shipping costs are borne by the Customer, unless the item cannot normally be returned by post, in which case the Operator will collect the Product at its own expense.
The statutory exceptions under Article L.221-28 of the French Consumer Code apply and prevent the exercise of the right of withdrawal, particularly if the order involves a contract for:
- the supply of services fully performed before the end of the withdrawal period and whose execution began with the consumer's prior express agreement and express waiver of the right of withdrawal;
- the supply of goods or services whose price depends on financial market fluctuations beyond the trader's control that may occur during the withdrawal period;
- the supply of goods made to the consumer's specifications or clearly personalized;
- the supply of goods liable to deteriorate or expire rapidly;
- the supply of goods unsealed by the consumer after delivery that cannot be returned for reasons of hygiene or health protection;
- the supply of goods which, after delivery and by their nature, are inseparably mixed with other items;
- the supply of alcoholic beverages whose delivery is deferred beyond thirty (30) days and whose agreed value upon conclusion of the contract depends on market fluctuations beyond the trader's control;
- urgent maintenance or repair work carried out at the consumer's home and expressly requested by them, limited to replacement parts and strictly necessary repairs;
- the supply of audio or video recordings or computer software unsealed by the consumer after delivery;
- the supply of a newspaper, periodical, or magazine, except for subscription contracts for such publications;
- contracts concluded at a public auction;
- the provision of accommodation services other than residential accommodation, goods transport services, car rental services, catering, or leisure activities to be provided on a specific date or period;
- the supply of digital content not provided on a tangible medium whose execution began with the consumer's prior express agreement and express waiver of the right of withdrawal.
Returned Products must be in their original packaging, in perfect condition, suitable for resale, unused, and complete with all accessories, if any.
In addition to the returned Product, the return parcel must include a letter detailing the Customer's exact and complete contact information (full name, address), the order number, and the original purchase invoice.
The Operator will refund the Customer the amount of the Product within fourteen (14) days from the date the Product and all necessary elements to process the refund are received. This refund may be issued using the same payment method as the one used by the Customer. In this regard, Customers who paid for their order using store credit / gift vouchers may be refunded via store credit / gift vouchers at the Operator's discretion.
By accepting these Terms and Conditions of Sale, the Customer expressly acknowledges having been informed of the withdrawal terms and conditions.
Article 12 – CUSTOMER SERVICE
The Customer may contact the Operator by email at contact@luuckk.com, specifying their name, phone number, the subject of their request, and the relevant order number.
Article 13 – INTELLECTUAL PROPERTY AND SITE USE LICENSE
The Operator and Madame Retail are the sole owners of all elements present on the Site, including without limitation all text, files, animated or static images, photographs, videos, logos, designs, models, software, trademarks, visual identity, database, Site structure, and all other intellectual property assets and other data or information (hereinafter, the "Elements"), which are protected by French and international laws and regulations governing intellectual property.
Consequently, none of the Elements of the Site may, in whole or in part, be modified, reproduced, copied, duplicated, sold, resold, transmitted, published, communicated, distributed, broadcast, represented, stored, used, rented, or exploited in any other manner, whether free of charge or for consideration, by a Customer or any third party, regardless of the media or means used, whether currently known or unknown, without the Operator's prior express written authorization on a case-by-case basis. The Customer is solely responsible for any unauthorized use and/or exploitation.
Furthermore, it is clarified that the Operator does not own user-generated content uploaded by Customers, for which Customers remain fully liable and hold the Company harmless against any related claims. Customers grant the Operator a non-exclusive, transferable, sublicensable, royalty-free, worldwide license to use the intellectual property content they post on the Site for the entire duration of the protection of such content.
The Operator reserves the right to take legal action against any person failing to comply with the prohibitions set forth in this article.
ARTICLE 14 – LIABILITY AND WARRANTY
The Operator cannot be held liable for failure to perform the contract caused by the Customer, due to an event of force majeure as recognized by the competent courts, or resulting from the unforeseeable and insurmountable act of an independent third party.
The Operator cannot be held liable for information imported, stored, and/or published on the Site by Customers. The Operator cannot be held liable for any information posted by a Customer on the Site or for any direct or indirect damage that such use may cause to a third party, the Customer posting such content remaining solely liable in this regard.
The Customer acknowledges that the characteristics and constraints of the Internet cannot guarantee the security, availability, and integrity of data transmissions online. Accordingly, the Operator does not warrant that the Site and its services will operate without interruption or operational errors. In particular, operations may be momentarily suspended for maintenance, updates, technical improvements, or to modify content and/or layout.
The Operator cannot be held liable for any use made of the Site and its services by Customers in violation of these Terms and Conditions, nor for any direct or indirect damage such use might cause to a Customer or third party. In particular, the Operator cannot be held liable for false statements made by a Customer or their conduct toward third parties. In the event the Operator's liability is sought due to such conduct by a Customer, the Customer agrees to indemnify and hold harmless the Operator against any judgment entered against it, and to reimburse all expenses, including attorney fees, incurred for its defense.
The Customer is solely responsible for all content uploaded to the Site, representing that they possess all requisite rights, and warrants to the Operator that they will not post content that violates third-party rights, particularly intellectual property rights, or constitutes an offense against persons (including defamation, insult, slander, etc.), privacy violations, breaches of public order, or offenses against public decency (including condoning crimes against humanity, inciting racial hatred, child pornography, etc.). In the event of a violation of applicable laws, public decency, or these Terms and Conditions, the Operator may rightfully suspend or ban offending Customers and remove relevant information and links. The Operator acts as a hosting provider regarding third-party content. As such, the Operator has no general obligation to monitor content transmitted or stored via the Site. Should the Operator's liability be sought due to content uploaded by a Customer, the Customer agrees to indemnify and hold harmless the Operator against any judgment entered against it and reimburse all defense costs and attorney fees.
Independently of any additional commercial warranty that may be offered, Products are covered by the statutory warranty of conformity provided in Articles L. 217-4 et seq. of the French Consumer Code (notably Articles L. 217-4 to L. 217-14 of the French Consumer Code) and the warranty against hidden defects provided in Articles 1641 to 1649 of the French Civil Code.
When invoking the legal warranty of conformity:
- you have a period of two (2) years from delivery of the good to take action;
- you may choose between repair or replacement of the good, subject to the cost conditions set forth in Article L. 217-9 of the French Consumer Code;
- you are exempt from providing proof of the lack of conformity of the good during the twenty-four (24) months following delivery (except for second-hand goods).
You may also decide to invoke the warranty against hidden defects of the sold item pursuant to Article 1641 of the French Civil Code. In this scenario, you may choose between the rescission of the sale or a reduction of the sale price in accordance with Article 1644 of the French Civil Code.
Reproduction of Articles L. 217-4, L. 217-5, L. 217-7, L. 217-9, and L. 217-12 of the French Consumer Code, and Articles 1641, 1644, and the first paragraph of Article 1648 of the French Civil Code, as in effect on the date of these Terms and Conditions:
Art. L.217-4 of the French Consumer Code:
"The seller shall deliver goods conforming to the contract and shall be liable for any lack of conformity existing upon delivery. The seller shall also be liable for any lack of conformity caused by packaging, assembly instructions, or installation when charged to the seller by the contract or carried out under the seller's responsibility."
Art. L.217-5 of the French Consumer Code:
"The good conforms to the contract:
1° If it is fit for the purpose usually expected of similar goods and, where applicable:
– if it matches the description given by the seller and possesses the qualities presented to the buyer as a sample or model;
– if it possesses the qualities that a buyer can legitimately expect in light of public statements made by the seller, the producer, or their representative, including in advertising or labeling;
2° Or if it presents the characteristics defined by mutual agreement between the parties or is fit for any special use sought by the buyer, brought to the attention of the seller, and agreed to by the seller."
Art. L.217-7 of the French Consumer Code:
"Lacks of conformity that appear within twenty-four months of delivery of the good are presumed to have existed at the time of delivery, unless proven otherwise.
For second-hand goods, this period is set at six months.
The seller may rebut this presumption if it is incompatible with the nature of the good or the alleged lack of conformity."
Art. L.217-9 of the French Consumer Code:
"In the event of a lack of conformity, the buyer chooses between repair and replacement of the good. However, the seller may choose not to proceed according to the buyer's choice if that choice imposes a manifestly disproportionate cost compared to the other option, taking into account the value of the good or the significance of the defect. The seller is then required to proceed, unless impossible, with the option not chosen by the buyer."
Art. L.217-12 of the French Consumer Code:
"Actions resulting from a lack of conformity are barred after two years from delivery of the good."
Art. 1641 of the French Civil Code:
"The seller is bound by the warranty against hidden defects of the thing sold that render it unfit for the use for which it was intended, or diminish such use to such an extent that the buyer would not have acquired it, or would have paid a lower price for it, had they known of them."
Art. 1644 of the French Civil Code:
"In the case of Articles 1641 and 1643, the buyer has the choice to return the thing and receive a refund of the price, or to keep the thing and receive a partial refund of the price."
Art. 1648 paragraph 1 of the French Civil Code:
"The action resulting from redhibitory defects must be brought by the buyer within two years of discovery of the defect."
Please note that seeking amicable resolutions prior to any legal proceedings does not interrupt the statutory warranty limitation periods or the duration of any commercial warranty.
ARTICLE 15 – COMMERCIAL WARRANTY
Any commercial warranty (contractual commitment of the Operator, in addition to its statutory obligations regarding the conformity of the Products) is subject to a written contract in accordance with the provisions of Articles L. 217-15 et seq. of the French Commercial Code, a copy of which is delivered to the Customer.
ARTICLE 16 – AFTER-SALES SERVICE
After-sales services provided by the Operator that do not fall under the commercial warranty are governed by an agreement, a copy of which is provided to the Customer.
Claims made under warranties must be sent to customer support at: contact@luuckk.com
Products covered by warranties must be returned new, complete, and in their original packaging and condition following receipt and confirmation of the claim by after-sales service.
The Customer will be refunded for return shipping fees no later than thirty (30) days following receipt of the product by the Operator.
ARTICLE 17 – PERSONAL DATA
For more information regarding the collection and use of personal data by the Operator, please carefully read our Privacy Policy (the "Policy"). You can consult this Policy on the Site at any time.
Article 18 – HYPERLINKS
Hyperlinks on the Site may lead to third-party sites not published by the Operator. They are provided solely for the Customer's convenience to facilitate access to online resources. If the Customer clicks these links, they will leave the Site and agree to browse third-party sites at their own risk and subject to the terms governing them.
The Customer acknowledges that the Operator does not control or contribute in any way to drafting the terms of use or content featured on these third-party websites.
Consequently, the Operator cannot be held liable in any way for such third-party links.
Furthermore, the Customer acknowledges that the Operator does not endorse, guarantee, or assume responsibility for any terms of use or content of these third-party sites.
The Site may also display promotional hyperlinks and/or advertising banners directing to third-party websites not published by the Operator.
The Operator invites the Customer to report any hyperlink on the Site leading to a third-party website offering content contrary to applicable laws or public decency.
The Customer may not create or insert hyperlinks pointing to the Site without prior express written consent from the Operator on a case-by-case basis.
ARTICLE 19 – REFERENCES
The Customer authorizes the Operator to display the Customer's name and logo as a client reference across marketing and communication media (brochures, website, sales proposals, press releases, press kits, internal communications, etc.).
ARTICLE 20 – GENERAL PROVISIONS
ENTIRE AGREEMENT
These Terms and Conditions constitute the entire agreement governing relations between the Customer and the Operator. They represent all rights and obligations of the Company and the Operator regarding their subject matter. If one or more provisions of these Terms and Conditions are declared null and void pursuant to a law, regulation, or final court decision, the remaining provisions shall retain their full force and scope. Furthermore, the failure of either party to enforce a breach by the other party of any provision hereof shall not be construed as a waiver of the right to enforce such breach in the future.
MODIFICATIONS TO THE TERMS
The Operator reserves the right to modify the content of the Site or available services at any time and without notice, and/or temporarily or permanently suspend operation of all or part of the Site.
In addition, the Operator reserves the right to alter the Site's online location and these Terms and Conditions at any time and without notice. The Customer is therefore required to consult these Terms and Conditions before each use of the Site.
The Customer acknowledges that the Operator cannot be held liable in any way toward them or any third party for such modifications, suspensions, or discontinuations.
The Operator recommends that the Customer save and/or print these Terms and Conditions for secure and durable storage, so as to be able to refer to them at any time during contract performance if necessary.

APPLICABLE LAW
These Terms and Conditions are governed by, construed, and enforced in accordance with French law.
ACCEPTANCE OF TERMS AND CONDITIONS BY THE CUSTOMER
The Customer acknowledges having read these Terms and Conditions carefully.
By registering on the Site, the Customer confirms having read and accepted the Terms and Conditions, thereby being legally bound by the terms hereof.
The Terms and Conditions applicable to the Customer are those in force on the date of the order, of which a dated copy may be provided to the Customer upon request. Any changes made to the Terms and Conditions by the Operator shall not apply to previously placed orders, except with the express agreement of the Customer who placed the order.
